UK Tax Returns due online by end of January 

Any person with a UK HMRC notice to make a UK self assessment (SA) return or any income arising from the UK beyond basic PAYE income must complete an online UK return by the end of January following the end of the UK a tax year.

The UK a tax year ends on 5th April and then returns can be prepared submitted online or paper by October or after that only online.

The deadline for 2020-21 UK tax returns is January 31 2022, after which penalties apply.

Expats cannot use the HMRC a online service as this is only for UK tax residents. All non resident expats must complete their SA return on paper or through a third party agent.

Do I need a UK tax return?

Even non residents can have UK tax return liabilities including:

  1. Income earned from a UK contract working remotely including PAYE or IR35

  2. Government Public Service pensions

  3. Property Rental income

  4. UK property sales during the year for Capital Gains Tax (CGT)

  5. Any asset sale property business or investment sale grossing more than £49200

  6. Share and investment sales

  7. Crypto sales, trading or reinvestments are liable to CGT

  8. If you breach non resident rules and have a worldwide tax liability to the UK through domicile

  9. If you are deemed to have a duel tax residence

There are capital gains and personal allowances and a return may not be necessary if for example no capital gain tax liability arises.

Even so capital losses need to be declared to reduce future tax liability against future capital gains.

All UK property sales now require a CGT tax return at the time of sale but should still be added to the year end tax return.

Public service pensions

public service pensions paid from the UK could remain taxable in the UK depending upon the expats country of tax residence.

Exemptions can apple but need claiming before December 1st each year.

If registered as a non resident landlord private landlords can enjoy income gross and settle tax annually.

Even if UK property rental income is taxed at source an end of year non resident tax return is still required.
